2สิทธิ์การเข้าถึงที่แอพขอ
แอพจะขอสิทธิ์ต่อไปนี้เมื่อจำเป็น คุณสามารถปฏิเสธหรือเพิกถอนได้ทุกเมื่อจากการตั้งค่าของ iOS แต่ฟังก์ชันที่เกี่ยวข้องจะใช้งานไม่ได้

3รูปภาพและข้อมูลของคุณ
รูปภาพของคุณเป็นของคุณ เราไม่อ้างสิทธิ์ความเป็นเจ้าของในภาพถ่ายหรือผลงานใด ๆ ที่คุณสร้างด้วยแอพนี้
ภาพถ่าย ไฟล์ RAW ค่าที่แต่ง ฟิลเตอร์ และสไตล์ทั้งหมดถูกเก็บไว้ในอุปกรณ์ของคุณ แอพไม่ส่งไฟล์หรือข้อมูลการใช้งานออกไปยังเซิร์ฟเวอร์ของเราหรือบุคคลที่สาม และไม่มีระบบเก็บสถิติการใช้งานหรือโฆษณา
เนื่องจากข้อมูลทั้งหมดอยู่ในเครื่องของคุณ คุณเป็นผู้รับผิดชอบในการสำรองข้อมูลเอง การลบแอพ การรีเซ็ตเครื่อง หรืออุปกรณ์เสียหาย อาจทำให้ข้อมูลที่ยังไม่ได้บันทึกลงคลังภาพหรือสำรองไว้สูญหายอย่างถาวร เรากู้คืนให้ไม่ได้เพราะเราไม่มีสำเนาของข้อมูลนั้น

4ฟิลเตอร์ สไตล์ และไฟล์กล้อง
แอพรองรับไฟล์สูตรแต่งรูปสามชนิด ได้แก่ ฟิลเตอร์ (.fleem) สไตล์ (.fleemx) และกล้อง (.fleemcam)
4.1 ฟิลเตอร์ที่ติดตั้งมากับแอพ
ฟิลเตอร์และกล้องที่มาพร้อมกับแอพเป็นทรัพย์สินของเรา เราอนุญาตให้คุณใช้ภายในแอพเพื่อแต่งภาพของคุณเองเท่านั้น โดยไม่อนุญาตให้ทำสำเนา แจกจ่าย ขายต่อ หรือพยายามถอดรหัสเพื่อดูค่าที่ใช้ภายใน สูตรเหล่านี้ถูกออกแบบมาให้ซ่อนค่าไว้โดยเจตนา และการหลบเลี่ยงกลไกดังกล่าวถือเป็นการละเมิดข้อกำหนดฉบับนี้
4.2 สูตรที่คุณสร้างเอง
สูตรที่คุณสร้างขึ้นเองเป็นของคุณ คุณส่งออก แจกจ่าย หรือขายได้ตามต้องการ
4.3 สูตรที่คุณนำเข้าจากผู้อื่น
ไฟล์ที่คุณนำเข้าจากบุคคลอื่นยังคงเป็นของผู้สร้างไฟล์นั้น คุณใช้ภายในแอพได้ แต่แอพจะไม่อนุญาตให้แก้ไขข้อมูลผู้สร้างหรือส่งออกต่อ และคุณตกลงจะไม่แจกจ่ายต่อโดยไม่ได้รับอนุญาตจากเจ้าของ
คุณเป็นผู้รับผิดชอบต่อไฟล์ที่คุณนำเข้ามาเอง เราไม่ได้ตรวจสอบและไม่รับผิดชอบต่อเนื้อหาหรือความปลอดภัยของไฟล์จากแหล่งอื่น
5การใช้งานที่ยอมรับได้
คุณตกลงว่าจะไม่ใช้แอพนี้เพื่อ
- ถ่ายภาพบุคคลอื่นโดยไม่ได้รับความยินยอม หรือในสถานที่ที่กฎหมายห้าม
- สร้างหรือเผยแพร่เนื้อหาที่ผิดกฎหมาย ละเมิดสิทธิผู้อื่น หรือเป็นภาพลามกอนาจารเด็ก
- ละเมิดลิขสิทธิ์ เครื่องหมายการค้า หรือสิทธิในความเป็นส่วนตัวของผู้อื่น
- ทำวิศวกรรมย้อนกลับ ถอดรหัส แกะสูตร หรือดัดแปลงแอพ ยกเว้นเท่าที่กฎหมายอนุญาตโดยชัดแจ้ง
คุณเป็นผู้รับผิดชอบแต่เพียงผู้เดียวต่อภาพที่คุณถ่ายและเนื้อหาที่คุณเผยแพร่
6ทรัพย์สินทางปัญญา
ตัวแอพ ซอร์สโค้ด อัลกอริทึมการประมวลผลภาพ ไฟล์ LUT ไอคอน ชื่อ และเครื่องหมาย “Fleem” และ “Fleem Cam” เป็นทรัพย์สินของเรา และได้รับความคุ้มครองตามกฎหมายทรัพย์สินทางปัญญา
เราให้สิทธิ์คุณแบบจำกัด เพิกถอนได้ ไม่ผูกขาด และโอนให้ผู้อื่นไม่ได้ ในการติดตั้งและใช้งานแอพบนอุปกรณ์ที่คุณเป็นเจ้าของหรือควบคุม เพื่อการใช้งานส่วนตัวและเชิงพาณิชย์ของคุณเอง ข้อกำหนดนี้ไม่ได้โอนกรรมสิทธิ์ใด ๆ ให้แก่คุณ
7ข้อจำกัดการรับประกัน
แอพนี้ให้บริการ “ตามสภาพที่เป็นอยู่” (as is) โดยไม่มีการรับประกันใด ๆ ไม่ว่าโดยชัดแจ้งหรือโดยปริยาย
เราไม่รับประกันว่าแอพจะทำงานได้ต่อเนื่องโดยไม่มีข้อผิดพลาด เข้ากันได้กับอุปกรณ์หรือ iOS ทุกรุ่น หรือให้ผลลัพธ์ของภาพตรงตามที่คุณคาดหวัง
โดยเฉพาะอย่างยิ่ง เราไม่รับประกันว่าจะไม่เกิดการสูญหายหรือเสียหายของไฟล์ภาพ กรุณาสำรองภาพสำคัญไว้เสมอ และอย่าใช้แอพนี้เป็นที่เก็บภาพเพียงแห่งเดียว
8ข้อจำกัดความรับผิด
ภายใต้ขอบเขตสูงสุดที่กฎหมายอนุญาต เราจะไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายพิเศษ ความเสียหายสืบเนื่อง การสูญเสียรายได้ การสูญเสียโอกาสทางธุรกิจ หรือการสูญหายของข้อมูลและภาพถ่าย อันเกิดจากการใช้งานหรือการไม่สามารถใช้งานแอพนี้
เนื่องจากแอพนี้ให้ใช้งานโดยไม่มีค่าใช้จ่าย ความรับผิดรวมของเราไม่ว่ากรณีใด ๆ จะไม่เกินจำนวนเงินที่คุณได้ชำระให้แก่เราสำหรับแอพนี้ ซึ่งปัจจุบันคือศูนย์บาท
ข้อจำกัดข้างต้นไม่ตัดสิทธิ์ที่ผู้บริโภคพึงมีตามกฎหมายคุ้มครองผู้บริโภคที่ใช้บังคับ ซึ่งไม่อาจยกเว้นได้
9การอัพเดทและการยุติการให้บริการ
เราอาจออกอัพเดทเพื่อแก้ไขข้อผิดพลาด เพิ่มหรือปรับเปลี่ยนฟีเจอร์ได้ตลอดเวลา บางฟีเจอร์อาจถูกเปลี่ยนแปลงหรือยกเลิกในเวอร์ชันถัดไป
เราอาจยุติการพัฒนาหรือถอนแอพออกจาก App Store เมื่อใดก็ได้ ในกรณีดังกล่าว แอพที่ติดตั้งอยู่บนเครื่องของคุณและไฟล์ทั้งหมดในเครื่องจะยังคงอยู่ แต่เราไม่มีหน้าที่ต้องให้การสนับสนุนต่อไป
10การเปลี่ยนแปลงข้อกำหนด
เราอาจแก้ไขข้อกำหนดฉบับนี้เป็นครั้งคราว ฉบับที่มีผลบังคับใช้คือฉบับที่ประกาศบนหน้านี้ พร้อมวันที่มีผลบังคับใช้ที่ระบุไว้ด้านบน การใช้งานแอพต่อไปหลังจากมีการเปลี่ยนแปลงถือว่าคุณยอมรับข้อกำหนดฉบับใหม่
11App Store
แอพนี้เผยแพร่ผ่าน Apple App Store ข้อตกลงฉบับนี้ทำขึ้นระหว่างคุณกับ Fleem เท่านั้น ไม่ใช่กับ Apple โดย Apple ไม่มีหน้าที่ให้บริการสนับสนุนหรือรับผิดชอบต่อแอพนี้ การใช้งานของคุณยังอยู่ภายใต้ข้อกำหนดการใช้บริการของ Apple ด้วย
12กฎหมายที่ใช้บังคับ
ข้อกำหนดฉบับนี้อยู่ภายใต้บังคับและตีความตามกฎหมายแห่งราชอาณาจักรไทย ข้อพิพาทที่เกิดขึ้นให้อยู่ในเขตอำนาจของศาลไทย

Please read these terms before using the app. By downloading or using Fleem Cam you agree to them. If you do not agree, please stop using the app and remove it from your device.
1About the app
Fleem Cam (the “App”) is a camera and photo-editing application for iOS, developed and provided by Fleem (“we”, “us”).
The App runs entirely on your device. There is no sign-up, no user account, and no internet connection is required to take or edit photos.
The App is currently free in full. There are no in-app purchases and no subscriptions. If paid features are introduced in the future, their terms will be presented to you beforehand, and features you already use for free will not be charged retroactively.
2Permissions the App requests
The App asks for the following permissions when it needs them. You may decline or revoke any of them at any time in iOS Settings; the related functions will then be unavailable.
- Camera — to take photos inside the app, for example when you press the shutter to capture a photo with the filter you have selected.
- Photo library — to save photos to your library only when you ask it to, for example by tapping the share button and choosing Save Image, and to bring in photos you select for editing.
The App does not request microphone access — it records neither video nor audio — and does not request location, contacts or health data.
3Your photos and your data
Your photos are yours. We claim no ownership of any photo or other work you create with the App.
Photos, RAW files, edit settings, filters and styles are all stored on your device. The App does not send files or usage data to our servers or to any third party, and it contains no analytics and no advertising.
Because everything lives on your device, backing it up is your responsibility. Deleting the App, resetting or damaging your device may permanently lose anything not yet saved to your photo library or otherwise backed up. We cannot recover it, because we hold no copy of it.
When you use the share button, iOS delivers the file to the destination you choose. What happens after that is governed by that service's terms, not by these.
4Filters, styles and camera files
The App supports three kinds of recipe file: filters (.fleem), styles (.fleemx) and cameras (.fleemcam).
4.1 Filters that ship with the App
Filters and cameras included with the App are our property. You are licensed to use them inside the App on your own images only. You may not copy, distribute, resell, or attempt to decrypt them to reveal the values they contain. These recipes are deliberately sealed, and circumventing that protection is a breach of these terms.
4.2 Recipes you create
Recipes you create yourself are yours. You may export, distribute or sell them as you wish.
4.3 Recipes you import from others
Files you import from another person remain the property of whoever made them. You may use them inside the App, but the App does not allow their creator details to be edited or the file to be re-exported, and you agree not to redistribute them without the owner's permission.
You are responsible for files you choose to import. We do not review them and are not responsible for their content or safety.
5Acceptable use
You agree not to use the App to:
- photograph or record other people without their consent, or anywhere the law forbids it;
- create or distribute unlawful material, material that infringes the rights of others, or child sexual abuse material;
- infringe anyone's copyright, trade marks or privacy rights;
- reverse engineer, decrypt, extract recipes from, or modify the App, except to the extent the law expressly permits.
You are solely responsible for the images you capture and the content you publish.
6Intellectual property
The App, its source code, its image-processing algorithms, its LUT files, its icons, and the names and marks “Fleem” and “Fleem Cam” are our property and are protected by intellectual property law.
We grant you a limited, revocable, non-exclusive, non-transferable licence to install and use the App on devices you own or control, for your own personal and commercial work. Nothing in these terms transfers ownership to you.
7Disclaimer of warranty
The App is provided “as is”, without warranty of any kind, express or implied.
We do not warrant that the App will run without interruption or error, that it is compatible with every device or iOS version, or that it will produce the image results you expect.
In particular, we do not warrant against loss of or damage to image files. Always keep backups of images that matter, and do not rely on the App as the only place your photos exist.
8Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, special or consequential damages, loss of revenue, loss of business opportunity, or loss of data or photographs, arising from your use of or inability to use the App.
Because the App is supplied free of charge, our total liability in any circumstance will not exceed the amount you have paid us for it, which is currently zero.
None of the above limits any consumer rights you may have under applicable consumer protection law that cannot lawfully be excluded.
9Updates and discontinuation
We may release updates to fix problems and to add or change features at any time. Some features may be changed or removed in a later version.
We may stop development or withdraw the App from the App Store at any time. If we do, the copy installed on your device and every file on your device remain yours, but we are under no obligation to continue supporting it.
10Changes to these terms
We may revise these terms from time to time. The version in force is the one published on this page, with the effective date shown at the top. Continuing to use the App after a change means you accept the revised terms.
11App Store
The App is distributed through the Apple App Store. This agreement is between you and Fleem only, not with Apple. Apple has no obligation to provide support for the App and no responsibility for it. Your use also remains subject to Apple's own terms of service.
12Governing law
These terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, and any dispute is subject to the jurisdiction of the Thai courts.
